一、彭庆春等与刘琼珍法定继承纠纷上诉案

【裁判要旨】

《中华人民共和国继承法》第十条规定了继承人范围及继承顺序，即，遗产按照下列顺序继承：第一顺序：配偶、子女、父母。第二顺序：兄弟姐妹、祖父母、外祖父母。据此，与被继承人同居生活的人，由于未办理结婚登记手续，并不属于被继承人的配偶，故不在被继承人的法定继承人范围之内。但是，根据《继承法》第十四条之规定，对继承人以外的依靠被继承人扶养的缺乏劳动能力又没有生活来源的人，或者继承人以外的对被继承人扶养较多的人，可以分配给他们适当的遗产。与被继承人长期同居生活的人，长期同居的事实足以表明其与被继承人之间存有相互扶养的行为，故可以依法适当分得被继承人的遗产。

[Judgment Abstract] 

Article 10 of the Law of Succession of the People's Republic of China provides the scope and order of heirs, stating that “the estate of the deceased shall be inherited in the following order: First in order: Spouse, children, parents; Second in order: Brothers and sisters, paternal grandparents, maternal grandparents.” Accordingly, the person who has lived in cohabitation with the deceased, is not deemed to be the spouse of the deceased because they have not registered their marriage, so the person does not fall under the scope of the deceased's statutory heirs. However, according to the provisions of Article 14 of the Law of Succession, an appropriate share of the estate may be given to a person, other than a successor, who depended on the support of the deceased and who neither can work nor has a source of income, or to a person, other than a successor, who was largely responsible for supporting the deceased. Therefore, in relation to a person who has lived in cohabitation with the deceased for a long time, the fact of long-term cohabitation is sufficient to show that there had been mutual support between them and the deceased, so he may properly share the legacy of the deceased according to the law.

二、范世贵诉范春等法定继承案

Fan Shigui v. Fan Chun, et al. (case regarding dispute over statutory succession)

【裁判摘要】

根据《继承法》第六条第二款的规定，限制行为能力人的继承权，由他的法定代理人代为行使，或者征得法定代理人同意后行使。另外，根据最高人民法院《关于贯彻执行〈中华人民共和国继承法〉若干问题的意见》第八条的规定，法定代理人代理被代理人行使继承权、受遗赠权，不得损害被代理人的利益；法定代理人一般不能代理被代理人放弃继承权、受遗赠权。明显损害被代理人利益的，应认定其代理行为无效。行为人作为限制行为能力人，在没有法定代理人监护的情况下放弃继承权的，不能预见到自己行为的性质及后果，因此，其放弃继承权的行为无效。

[Judgment Abstract]

In accordance with paragraph 2 of Article 6 of the Law of Succession of the People's Republic of China, “The right of succession or legacy of a person with limited capacity shall be exercised on his behalf by his statutory agent or by such person himself after obtaining the consent of his statutory agent.” In addition, Article 8 of the Opinions of the Supreme People's Court on Several Issues Concerning the Implementation of the Law of Succession of the People's Republic of China stipulates, “The statutory agent shall exercise the right of succession and legacy on behalf of the principal without damaging the interests thereof. In general, the statutory agent is not allowed to waive the right of succession and legacy on behalf of the principal. If the principal's interests have been damaged obviously, the act of agency should be deemed invalid.” An actor, as a person with limited capacity, is unable to foresee the nature and consequences of the renouncement of the right of succession in the absence of the guardianship of his statutory agent. Therefore, such renouncement is null and void.

三、于立丽与王正宽、张宝珍法定继承纠纷案

Yu Lili v. Wang Zhengkuan, Zhang Baozhen (case regarding dispute over statutory succession)

【裁判摘要】

遗产是指被继承人死亡时遗留的个人所有财产和法律规定可以继承的其他财产权益。根据《婚姻法》第十八条的规定，一方因身体受到伤害获得的医疗费、残疾人生活补助费等费用，为夫妻一方的财产。因此，被继承人去世后，其生前因交通事故获得的医疗费、残疾生活补助费，系其身体受到伤害获得的赔偿，应依法认定为个人财产，应作为遗产继承。而被继承人所涉赔偿款中的误工费，系其因伤无法得到应得的工资而获得的赔偿，应属婚姻关系存续期间所得财产，属于夫妻共同财产，若涉及到继承问题，应先将其配偶的部分析出后再继承。另外，根据《婚姻法》第十八条中的规定，遗嘱或赠与合同中确定只归夫或妻一方的财产，为夫妻一方的财产。故单位和社区的捐款捐赠的目的是为了救治被继承人，应为被继承人的个人财产，应作为遗产继承。

[Judgment Abstract]

Estate denotes all personal property and other legally inheritable rights and interests of property left by a natural person at the time of his death. In accordance with Article 18 of the Marriage Law of the People's Republic of China, “The payment for medical treatment or living subsidies for the disabled arising from a bodily injury on either party, shall be owned by either the husband or the wife.” Therefore, medical expenses or disability living allowances arising from a traffic accident obtained by the decedent before his death, are the compensation for his bodily injury and should be legally determined as the estate to be inherited. The charge for loss of working time in the damages is the compensation for loss of due salary because of injury arising from a traffic accident and belongs to the properties jointly owned by husband and wife during the existence of their marriage. If the charge for loss of due salary is involved in the inheritance, half of the charge should be first allotted to the surviving spouse. In addition, Article 18 of the Marriage Law of the People's Republic of China stipulates, “Property acquired from inheritance or gift, shall be owned by either the husband or the wife.” Accordingly, the donation from the unit and community for the decedent's medical treatment is the personal property of the decedent and should be inherited as the estate.
